The injury began with a fall that people wouldn’t think twice about. During work, the manager slipped on the ice and struck his head on the concrete. The following concussion failed to improve. His symptoms were serious: headaches, vision loss, memory loss, trouble finding and saying words, slow and slurred speech, dizziness, a left leg drag, tremors, staring spells, and anxiety with panic attacks, along with a high risk of falls. He underwent cognitive, vestibular, speech, memory, and physical therapy and was prescribed concussion medications.

Because the insurer recognized the injury as catastrophic, his temporary total disability (TTD) benefits would be paid for life rather than being capped at 400 weeks. Using his $800 weekly comp rate and a 14.36-year life expectancy, that is 746.72 weeks, or roughly $597,376 in future income-benefit exposure, on top of a lifetime of medical treatment. Based on those numbers, the insurer's initial $50,000 offer did not reflect what this worker lost or would continue to need.

The final resolution was a $350,000 lump sum paired with a $97,446.92 Medicare Set-Aside. This put money in the client's hands now and set aside funds for his ongoing workers' compensation medical care.
